Terms of Service

These Terms of Service ("Terms") govern your access to and use of FormJet ("Service"), operated by Appa Digital LLC ("Company," "we," "us," or "our"), a Massachusetts limited liability company. By creating an account or using the Service, you agree to be bound by these Terms.

1. Service Description

FormJet is a software-as-a-service platform that enables users to create, publish, and manage online forms, surveys, and questionnaires. The Service includes a form builder, form viewer, response analytics, integrations with third-party services, and AI-assisted features.

2. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to use the Service.

3. Plans and Billing

FormJet offers Free and paid (Pro) plans. Paid subscriptions are billed monthly through Stripe. You may cancel at any time through the Settings page or Stripe Customer Portal. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods.

4. Your Data

4.1 Form Content

You retain full ownership of the forms you create and the responses you collect through the Service. We do not claim any intellectual property rights over your content.

4.2 Response Data

You are the data controller for responses collected via your forms. You are responsible for obtaining any necessary consent from your respondents and for complying with applicable data protection laws regarding the data you collect.

4.3 Data Portability

You may export your form responses at any time in CSV format. Upon account deletion, all your data will be permanently removed within 30 days.

5. AI-Assisted Features

FormJet includes AI-assisted features powered by third-party AI models for generating and modifying form questions. By using these features:

  • You acknowledge that AI-generated content may require review and editing before use.
  • Your form title and existing question titles are sent to the AI provider to generate contextual suggestions. Form response data is never sent to AI providers.
  • We do not guarantee the accuracy, completeness, or appropriateness of AI-generated suggestions.
  • You are responsible for reviewing and approving all AI-generated content before publishing.

6. Acceptable Use

You agree not to use the Service to:

  • Collect sensitive personal data (Social Security numbers, financial account numbers, health records) without appropriate safeguards and legal basis.
  • Create forms for phishing, fraud, spam, or any unlawful purpose.
  • Collect data from children under 13 without verifiable parental consent as required by COPPA.
  • Distribute malware or engage in any activity that disrupts the Service.
  • Violate any applicable laws or regulations.
  • Resell or redistribute the Service without our written permission.

We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.

7. Integrations and Third-Party Services

The Service may integrate with third-party services (Google Sheets, Slack, webhooks, etc.). These integrations are provided for convenience. We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party integrations is subject to their respective terms and privacy policies.

8. Intellectual Property

The Service, including its design, code, logos, and documentation, is owned by Appa Digital LLC and protected by intellectual property laws. "FormJet" is a trademark of Appa Digital LLC. Portions of this software were developed with AI-assisted coding tools.

You may not copy, modify, reverse engineer, or create derivative works based on the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

IN NO EVENT SHALL APPA DIGITAL LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.

10. Indemnification

You agree to indemnify and hold harmless Appa Digital LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your collection and handling of respondent data.

11. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Massachusetts. You agree to waive the right to a jury trial and to participate in any class action.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Termination

You may terminate your account at any time. We may suspend or terminate your access to the Service at our discretion, with or without cause. Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account closure.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
